Kevin,

As far as the format of the presentation goes, it could use some 
stylistic adjustment. There could be a better contrast between font and 
background color, so as to better emphasize the text, especially when 
there is just one word on the slide. Also, try another font--not all 
text should be in caps or small caps, it just makes the text appear to 
be yelling at the audience. Use caps sparingly and with reasonable 
intentions. Lessig uses mostly lower case and even internet slang like: 
"u" instead of "you." If you want a more digital-oriented font, try 
Lucida Console or Lucida Bright. If you just want to get the point 
across with a sans-serif font, try Futura, which also looks really nice 
in caps and small caps. Also, can you get some higher resolution 
screenshots and graphics? Clarity and legibility of images is critical 
and more professional/serious.
Last thing, maybe try (after you've finished editing and changing the 
fonts however you choose), formating the "offline" to fall directly on 
top of the "o" in "out" on the "Three Strikes and You're Out" slide.
