<P>i am way behind on this discussion, but would like to chime in. what is the original case? </P>
<P>i think the exception between comparing the p2p networks and youtube, if i'm not mistaken, is the downloading capabilities. if things can't be downloaded on youtube, is it a violation, or comparable to streaming songs? although, there are the similarities of a system in which the users supply the content. </P>
<P>there is a very good law review article that followed the grokster case and makes the arguments for how copyrights essentially have become unworkable/obsolete in the digital age because of the user-supplied systems like grokster and youtube. otherwise, if companies themselves are liable, who would want to run the risk of having a system in which users were permitted to supply the content? or, they could avoid the liability through programming efforts like p2p folks did following grokster, napster, and etc. to detach themselves as much as possible from the network which they had provided. copyright can't be conceived within it's traditional boundaries anymore because of the change in technology and content placement/distro. </P>
